The court in O’Rourke v. Vuturo 49 Va. App. 139, 638 S.E.2d 124 (2006) stated that trial court had authority to order independent psychological evaluation of child to assist it in determining potential psychological consequences of severing long-term relationship of child and mother’s ex-husband and whether actual harm would occur as a result, in child visitation dispute in which mother’s ex-husband sought visitation with child, born during ex-husband’s marriage to mother, over objections of mother and biological father, as such evaluation fell under scope of statute permitting court, in child custody or visitation cases, to order independent mental health or psychological evaluation to assist it in its determination of child’s best interests.
